Your use of our website constitutes acceptance of these Terms. Engagement of our Services is formalised through our service agreement or an engagement letter, which supplements these Terms.

Prasert provides inheritance and estate legal services in Thailand, principally to clients located in Khon Kaen Province and the surrounding region. Our Services are described on our website and may be varied by agreement in writing.

Our Services are not intended as general legal advice on matters unrelated to inheritance and estate administration. We reserve the right to decline to act in any matter at our discretion.

Availability of Services is subject to our capacity. We will advise you promptly if we are unable to take on your matter.

5. Fees and Payment

Our service fees are as follows, stated in Thai Baht (฿):

Fees are payable in advance of the commencement of each service, unless agreed otherwise in writing. We accept payment by bank transfer and cash. Receipts will be provided on request.

Third-party costs such as court filing fees, land office fees, or notarial charges are not included in the above fees and will be communicated to you in advance.

Refund Policy

For the First Conversation, no refund is available once the session has taken place. For Estate Paperwork Support and End-to-End Estate Support, fees paid for work already completed are non-refundable. Where work has not yet commenced on a particular stage, we will use reasonable discretion in considering a partial refund.

6. Service Delivery

We will carry out the Services with reasonable care and skill and in accordance with applicable professional standards. We will keep you informed of progress and will not take steps in your matter without your knowledge.

Timelines are estimates and may be affected by third-party processes, court schedules, or circumstances beyond our control. We will notify you of any material delays as soon as practicable.

7. Confidentiality

All information you share with us in connection with your estate matter is held under professional legal confidentiality. We will not disclose your information to third parties except as required to carry out the Services, as required by law, or with your explicit consent. Please also see our Privacy Policy.

8. Intellectual Property

All content on the Prasert website, including text, design elements, and structure, is the property of Prasert and is protected by applicable Thai intellectual property law. You may not reproduce, distribute, or adapt any part of our website content without our prior written consent.

Documents we prepare on your behalf as part of the Services belong to you once fees are settled in full.

The information on our website is provided for general informational purposes only and does not constitute legal advice. Estate matters are fact-specific; you should not rely on website content as a substitute for advice tailored to your situation.

We do not make any representations about the outcome of your estate matter. Legal proceedings and administrative processes involve inherent uncertainty, and outcomes cannot be assured.

To the extent permitted by Thai law, our aggregate liability to you for any claim arising in connection with the Services shall not exceed the total fees paid by you to us for the relevant service.

We shall not be liable for indirect, consequential, or special losses, or for losses arising from circumstances beyond our reasonable control including court decisions, changes in law, or delays by third parties.

11. Indemnification

You agree to indemnify and hold Prasert harmless from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misrepresentation of material facts, or your unlawful conduct in connection with our Services or website.

12. Termination

Either party may terminate the engagement by giving reasonable written notice. We may terminate immediately if you provide materially false information, fail to pay fees, or act in a manner that compromises our professional obligations.

On termination, you remain liable for fees in respect of work carried out to the termination date. We will provide reasonable assistance in transferring your matter to another adviser.

13. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage you to contact us first to seek an informal resolution. If no resolution is reached, disputes shall be submitted to the jurisdiction of the courts of Khon Kaen Province.

Clients may also raise concerns about our professional conduct with the Lawyers Council of Thailand.

We may update these Terms from time to time. The current version will be posted on our website with the revision date. Continued use of our website or Services following an update constitutes acceptance of the revised Terms. For active client matters, material changes will be communicated directly.
